The CFTC responded to a market emergency notification from KalshiEX, LLC by ordering the exchange to operate in accordance with the Commodity Exchange Act’s core principles. This move follows a lawsuit filed by New York Attorney General Letitia James, which seeks to prohibit KalshiEX from offering event contracts nationwide and claims damages exceeding $36 billion. The lawsuit, filed on July 31, aims to restrict the exchange under state gaming laws, which the CFTC argues are inappropriate for regulating interstate financial markets.

The CFTC emphasized its mandate to provide a uniform national market for derivatives, ensuring resilience, orderliness, and fair competition. The agency criticized the legal actions by states like New York, asserting that derivatives exchanges operate across state lines and should not be subject to state-level gaming regulations. The CFTC has actively filed lawsuits and amicus briefs against several states, including Arizona, Connecticut, Illinois, Kentucky, Minnesota, New Mexico, Rhode Island, and Wisconsin, to protect its jurisdiction.
