The Commodity Futures Trading Commission (CFTC) has announced that it considers certain crypto perpetual contracts as foreign futures, aligning with existing regulations. This clarification came through an official interpretation and no-action letter issued to Coinbase Financial Markets, Inc., a registered futures commission merchant. The letter relates to Coinbase's plan to offer digital commodity derivatives on its affiliated foreign board of trade, Deribit FZE.
The CFTC's staff confirmed that these perpetual contracts meet the definition of foreign futures, which impacts how they are regulated and traded across borders. Additionally, the agency stated that, under specific conditions, it will not pursue enforcement actions against Coinbase for transferring customer-owned digital assets and stablecoins to foreign brokers to serve as margin for foreign futures and options.
